GENERAL CONDITIONS OF USE OF THE WEBSITE


1. - Object.

The present general conditions (hereinafter referred to as General Conditions), regulate the access and use of the Website under the domain www.DENIASOL.es (hereinafter referred to as Website), owned by "COSTAGALATEA, S. L.". (hereinafter DENIASOL), made available to users (hereinafter User (s).

2. - Conformity with the present General Conditions.

The use of the Website implies the full acceptance by the User of all the General Conditions in force at any time the User accesses it. Therefore, if you do not agree with any of the conditions established herein, you must refrain from using this Website.

Consequently, the User must read the General Conditions carefully each time he/she intends to use the Website.

In any case, DENIASOL reserves the right to modify, without prior notice and at any time, the present General Conditions, as well as their configuration, location and any other general or particular terms, regulations of use, instructions or warnings that are applicable. Likewise, DENIASOL reserves the right to suspend, interrupt or stop operating the Website at any time.

By "use of the Website", any User who accesses and navigates through the Website regardless of whether he or she completes the registration forms.

3. - Conditions of Access and Use of the Website and its Contents.

Access to the Website and/or the Contents included therein does not imply any guarantee of the suitability of the Website and/or the Contents included therein for particular or specific purposes of the Users.

DENIASOL may establish limitations and/or additional conditions for the use of and/or access to the Website and/or the Contents, which must be observed by the Users in any case.

Unless otherwise provided, the use of the Website shall be free of charge, without prejudice to the cost of connection through the corresponding telecommunications network contracted by the User.

The User acknowledges to be over eighteen years of age, is also aware and accepts voluntarily and expressly that the use of the Website is made in any case under its sole and exclusive responsibility.

The User undertakes to comply with the present General Conditions, as well as to comply with the special warnings or instructions contained in the Website and to always act in accordance with the law, good customs and the requirements of good faith, using his maximum attention taking into account the nature and compensation of the service he enjoys. To this end, it will refrain from using the Website in any way that may prevent, damage or impair the normal functioning of the same, the goods or rights of DENIASOL, its suppliers, its distributors, the rest of Users or in general any third party.

Specifically and without this implying any restriction to the obligation assumed by the User in general in accordance with the previous paragraph, the User undertakes to use the Website:

DENIASOL endeavours to ensure that the Contents are of the highest possible quality and reasonably up to date, but does not guarantee the usefulness, accuracy, completeness, relevance and/or timeliness of the Contents.

4.- Intellectual and Industrial Property Rights.

By means of these General Conditions, no intellectual or industrial property rights are transferred on the Website or on any of its component elements, being expressly prohibited to the User the reproduction, transformation, distribution, public communication, making available, extraction, reuse, resending or use of any nature, by any means or procedure, of any of them, except in those cases in which it is legally permitted or authorized by the holder of the corresponding rights.

DENIASOL will carry out, provided that circumstances do not occur that make it impossible or difficult to execute and as soon as it has news of errors, disconnections and/or lack of updating of the contents, all those tasks aimed at correcting the errors, re-establishing communication and / or updating the referred content.

Likewise, DENIASOL does not guarantee either the technical reliability of its Website or access to its different pages, remaining in the same way exonerated from any liability for damages of any nature that may arise from this cause.

iv) DENIASOL reserves the right to block the Hyperlinks directed to the Website that do not have prior express authorization, even if they comply with the provisions of this section of the General Conditions

7.- Actions in case of Non-compliance.

DENIASOL reserves the right to exercise whatever actions are available in law to demand the responsibilities arising from the breach of any of the provisions of these General Conditions of the Website by a user.

8.- Partial Nullity.

The declaration of any of the clauses contained in these General Conditions as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining clauses, which shall remain binding between the parties.

9.- Applicable Law and Jurisdiction

These General Conditions shall be governed by the provisions of Spanish law.

Any controversy relative to the conditions of use and access to this Website contained in the present document of General Conditions of the Website, the parties submit themselves, expressly renouncing any other jurisdiction that could correspond to them, unless by legal imperative it is determined otherwise, to the Courts of Dénia.

10.- Notifications.

For the purposes of making the appropriate notifications, DENIASOL designates as the contact address the address specified in the legal notice.

The e-mail address provided by the User during the registration process on the Website will be that used by DENIASOL for the purpose of making notifications to the User.

The User is obliged to keep the data referred to in this clause duly updated for notification purposes.

All Notifications made by DENIASOL to the User shall be considered validly effected if they have been made using the data and through the aforementioned means. DENIASOL shall not be held liable for any damage that may occur as a result of the User's breach of his obligation to keep his contact details updated.
